These Website Terms of Use (these “Terms”) govern your access to and use of objectionly.com and any other website, landing page, or web property operated by Objectionly, Inc., a Delaware corporation (“Objectionly,” “we,” “us”), together with the content, materials, and features made available on them (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
IMPORTANT: THESE TERMS GOVERN THE SITE ONLY. THEY DO NOT GRANT ACCESS TO, OR GOVERN YOUR USE OF, THE OBJECTIONLY PLATFORM. USE OF THE PLATFORM IS GOVERNED EXCLUSIVELY BY A SEPARATE WRITTEN SUBSCRIPTION AGREEMENT, AS DESCRIBED IN SECTION 2.
1. Who May Use the Site
1.1 Age. The Site is intended for business users. You must be at least eighteen (18) years old to use the Site. Objectionly does not knowingly collect information from anyone under eighteen (18) through the Site.
1.2 Authority. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you and that organization.
1.3 Business Use. The Site is directed to businesses and business professionals. It is not directed to consumers, and Objectionly does not offer the Services to individuals for personal, family, or household purposes.
2. Relationship to the Subscription Agreement
2.1 Separate Agreement Required. Access to the Objectionly platform, including any pilot, evaluation, or paid subscription (the “Services”), requires a separate Objectionly Subscription Agreement signed by Objectionly and the customer (the “Subscription Agreement”). These Terms do not grant any right to access or use the Services.
2.2 Online Sign-Up. Where Objectionly makes an online sign-up available, completing that sign-up constitutes signature of the Subscription Agreement by electronic means, and the Subscription Agreement presented during sign-up governs the resulting subscription. Objectionly will make the Subscription Agreement available for review before acceptance and will provide a copy on request.
2.3 Conflicts. If these Terms conflict with a Subscription Agreement, the Subscription Agreement controls with respect to the Services, and these Terms control with respect to the Site.
3. The Site
3.1 License to Use the Site. Subject to these Terms, Objectionly grants you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your own internal business purposes and to evaluate Objectionly’s products and services.
3.2 Changes to the Site. Objectionly may modify, suspend, or discontinue the Site or any part of it at any time, without notice and without liability.
3.3 Accounts and Credentials. If the Site provides account credentials, you are responsible for maintaining their confidentiality and for all activity under your account and will notify Objectionly promptly of any unauthorized use.
4. Acceptable Use of the Site
You will not, and will not permit any other person to:
(a) use the Site for any unlawful purpose or in violation of these Terms;
(b) copy, reproduce, republish, frame, mirror, or redistribute any part of the Site except as expressly permitted;
(c) scrape, crawl, harvest, or use any automated means to extract data from the Site, or access the Site other than through the interfaces Objectionly provides;
(d) use any content from the Site to train, fine-tune, or evaluate any machine learning model;
(e) reverse engineer, decompile, or attempt to derive the source code or underlying structure of the Site;
(f) probe, scan, or test the vulnerability of the Site, or breach or circumvent any security or authentication measure;
(g) upload or transmit any malicious code, or interfere with the operation, integrity, or performance of the Site;
(h) impersonate any person or misrepresent your affiliation with any person or entity; or
(i) use the Site to develop, market, or support a product or service that competes with Objectionly.
5. Intellectual Property
5.1 Ownership. The Site and all content on it, including text, graphics, logos, images, video, software, and the selection and arrangement of that content, are owned by Objectionly or its licensors and are protected by copyright, trademark, and other intellectual property laws.
5.2 Trademarks. “Objectionly” and the Objectionly logo are trademarks of Objectionly, Inc. You may not use them without Objectionly’s prior written consent, except to refer accurately to Objectionly or its products.
5.3 Reservation. All rights not expressly granted in these Terms are reserved.
6. Your Submissions
6.1 Scope. You may submit information to Objectionly through the Site, such as a demo request, a contact form, a newsletter sign-up, or a job application (“Submissions”). Do not submit confidential information, personal information about third parties, call recordings, transcripts, protected health information, or any other sensitive data through the Site.
6.2 Limited License. You grant Objectionly a non-exclusive, worldwide, royalty-free license to use, reproduce, and store your Submissions solely to respond to your inquiry, to provide the information or materials you requested, and to operate and improve the Site. Objectionly claims no ownership of your Submissions and will not sell, publish, broadcast, or license them to third parties.
6.3 Feedback. If you send Objectionly suggestions or feedback about its products or the Site, Objectionly may use that feedback without restriction, obligation, or compensation. This Section does not apply to Customer Data under a Subscription Agreement.
7. Communications
7.1 Electronic Communications. By providing your contact information, you consent to receive communications from Objectionly electronically, including regarding your inquiry, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
7.2 Marketing. Objectionly may send you marketing communications about its products and services. You may opt out at any time using the unsubscribe link in any marketing email or by contacting Objectionly at team@objectionly.com. You will continue to receive transactional and account-related communications.
7.3 Telephone and Text. If you provide a telephone number and consent to be contacted, you consent to receive calls and text messages from Objectionly at that number, including through automated means, regarding your inquiry and Objectionly’s products. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of text messages.
8. No Advice, No Guarantee of Results
8.1 Informational Only. Content on the Site is provided for general informational purposes. It is not legal, compliance, financial, medical, or human resources advice, and you should not act on it without obtaining advice from a qualified professional.
8.2 Call Recording Compliance. Nothing on the Site constitutes a determination that any recording, monitoring, or analysis of any communication complies with any federal, state, or foreign law. Customers are solely responsible for obtaining the consents and providing the notices that applicable wiretap, eavesdropping, communications-privacy, and biometric privacy laws require.
8.3 Results Not Typical. Any performance figure, revenue increase, time saving, or other result described on the Site reflects the experience of a particular customer under that customer’s own circumstances. Results vary and depend on factors outside Objectionly’s control, including the customer’s market, offering, personnel, and sales process. Objectionly does not represent, warrant, or guarantee that you will achieve any particular result, and no statement on the Site is a warranty or a term of any agreement.
8.4 Endorsements. Testimonials and endorsements on the Site are provided by actual customers or users. Some endorsers may receive compensation, a referral fee, or other consideration, including under Objectionly’s referral or affiliate program. Any material connection is disclosed adjacent to the endorsement.
9. Third-Party Content and Links
9.1 Links. The Site may link to third-party websites, content, or services that Objectionly does not control. Objectionly does not endorse and is not responsible for them, and your use of them is governed by their own terms.
9.2 Third-Party Technology. The Site uses third-party analytics, hosting, and marketing technologies. Objectionly’s use of information collected through those technologies is described in the Privacy Policy.
10. Privacy
10.1 Privacy Policy. Objectionly’s collection and use of information through the Site is described in the Privacy Policy, available at https://objectionly.com/privacy-policy, which is incorporated into these Terms by reference.
11. Disclaimers
THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” OBJECTIONLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, AND STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. OBJECTIONLY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.
Nothing in this Section limits any warranty Objectionly expressly gives in a Subscription Agreement.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBJECTIONLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT, OR OTHERWISE.
OBJECTIONLY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
These limitations apply to the Site only. Liability arising under a Subscription Agreement is governed by that agreement.
13. Indemnification
You will defend, indemnify, and hold harmless Objectionly and its officers, directors, employees, and agents from any third-party claim, and related losses and reasonable attorneys’ fees, arising out of your use of the Site, your Submissions, or your breach of these Terms.
14. Governing Law and Disputes
14.1 Governing Law. These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles.
14.2 Arbitration. Any dispute arising out of or relating to these Terms or the Site will be finally resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, seated in Chicago, Illinois. Judgment on the award may be entered in any court of competent jurisdiction.
14.3 Class Waiver. Each party waives any right to bring or participate in any dispute as a class, collective, consolidated, or representative proceeding. If this waiver is held unenforceable as to a claim, that claim will be severed and resolved in court under Alternative B.
14.4 Injunctive Relief. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.
14.5 Limitations Period. Any claim arising out of or relating to these Terms or the Site must be brought within two (2) years after the claim accrued.
15. Changes to These Terms
Objectionly may update these Terms from time to time. The “Last updated” date at the top indicates when they were last revised. Material changes take effect when posted, and your continued use of the Site after posting constitutes acceptance. Changes to these Terms do not amend any Subscription Agreement, which may be amended only as that agreement provides.
16. General
16.1 Termination. Objectionly may suspend or terminate your access to the Site at any time, for any reason, without notice.
16.2 Export and Sanctions. You represent that you are not located in, and are not owned or controlled by any person located in, a jurisdiction subject to comprehensive United States sanctions, and that you are not identified on any United States government restricted-party list.
16.3 Severability and Waiver. If any provision is held unenforceable, it will be modified to the minimum extent necessary to be enforceable or severed, and the remainder will continue in effect. No failure to enforce operates as a waiver.
16.4 Assignment. You may not assign these Terms. Objectionly may assign them without restriction.
16.5 Entire Agreement. These Terms are the entire agreement between you and Objectionly regarding the Site and supersede any prior terms of service, terms of use, or similar terms previously posted. They do not supersede any Subscription Agreement.
